Pennsylvania’s Grounds for Divorce

Divorce is a complicated process that involves many steps. First, the divorcing spouse needs to file for termination of the marriage and have papers served to the other spouse. It is normally assumed that spouses are separated at the time that the papers are served. In Pennsylvania, one of the parties of the divorce must be a resident of the commonwealth for at least six months in order to file.

Mutual consent:

If both parties agree that the marriage is irretrievably broken this is quickest and simplest ground for a divorce. In Pennsylvania, the spouses must wait 90 days after serving the divorce papers before filing additional paperwork to consent to the divorce.

Irretrievably breakdown:

If the parties can prove that the marriage is irretrievably broken and that the parties have lived separately for at least two years, the couple can divorce on these grounds.

Institutionalization:

The court may grant a divorce on the grounds that insanity or serious mental disorder resulted in confinement in a mental institution of one spouse for at least 18 months prior to the divorce filing.

Fault:

The court can grant a divorce to an innocent and injured spouse when the other spouse deserts him or her for more than one year or commits adultery. Also, if the spouse committed a bigamous marriage or was physically damaging and violent to the spouse, then he or she is at fault for the breakdown of the marriage.

Other Pennsylvania Divorce Laws

In Pennsylvania, a spouse may be asked to meet with a counselor, and the court may require the couple to attend marriage counseling for a period of not less than 90 days nor more than 120 days. The court also has the right to equitably divide property in a distribution arrangement without regard to marital conduct after considering a variety of factors. The court will also determine alimony after considering a wide variety of factors that can influence these proceedings.
